David City votes on police department

DAVID CITY -- The question on the special mail-in ballot for David City voters is a simple yes or no: “Shall the City of David City, Nebraska, own and operate its own police department?”

The path to the special election, however, was anything but simple.

The City Council set the special mail-in election in December after council members deadlocked on another longstanding issue: whether to build a new police station after the current station was sold in September to egg processor Henningsen Foods.

The six council members got hung up on three options: build a new station, build a city hall/police station, or bring the police station into the current city hall.

Doubts about the future of the David City Police Department first arose last April, when the city proposed to sell the police station.

Then, citizens worried about the department’s possible demise said voters, not the council, should decide such a drastic change. Now, that wish has come to fruition.

Since Jan. 21, David City voters have been casting ballots ” by mail or by hand delivery ” to decide whether the city of 2,500 continues to operate a police department.

The deadline for returning ballots to the Butler County Clerk’s Office is 5 p.m. Tuesday.

Since the council approved the special election in December, the public debate on the issue has gone quiet. A handful of yard signs urge voters to keep the department, but organized and vocal campaigns have not developed for either side.

Mayor Dana Trowbridge has said that if the department is kept, rebuilding it will be a challenge for two reasons: The city has an “antiquated” pay scale that can’t compete with other cities, and a “cloud of negativity” remains over the city following a failed mayoral recall effort.

Supporters of the police department counter that the city could rehire officers who either were not reappointed or who resigned. Police Chief Steve Sunday resigned in November after being told he probably would not be reappointed. Another officer followed him out the door. The department now has two officers on staff and gets patrol assistance from the Butler County Sheriff’s Office.

If voters decide not to keep the police department, the other option is a Sheriff’s Office contract to patrol the city. Sheriff Mark Hecker, with the county board’s blessing, would hire three additional deputies to provide 24-hour patrol coverage for the city.

The county proposal would cost the city $240,000 per year. By comparison, the police department’s budget is $437,000 for 2009-10.

As the deadline for casting ballots approaches, more opinions have come forward.

County Supervisors Max Birkel and Bill Kozisek wrote a letter to The Banner-Press expressing their support for the county proposal. They said the sheriff’s office staff could assume the patrol duties without adding facilities.

“We believe contracting with the county is a fiscally better solution for the law enforcement services for David City. In our opinion, residents will only notice a change in the color of cars and uniforms,” the supervisors’ letter stated.

Opponents of closing the police department also have voiced opinions. Former sheriff Leo Meister wrote that the police department should be kept and that the council, not voters, should decide the department’s future. He said the mayor is to blame for the negativity in town because the mayor successfully challenged the recall effort, which was disqualified in District Court.

Steve Gaston, an organizer of the failed recall effort, alleged that the city’s police budget was inflated and misinformation was presented to sway the voters against keeping the department. The cost of the county contract would be dramatically higher than has been proposed, he wrote.

The voters will have the final say.

I was an officer in David City and and don't miss it at all. That town loves to make life miserable for the officers. The Council will run out whoever they don't like. Frankly they will get what they deserve for not standing up for Chief Sunday. See what kind of service they will get from the Sheriff. Poor at best. Voters should get it right. Recall Trowbridge and most of the Council, build a new Police Department seperate from any other office, and re-hire Chief Sunday.

Never did I ever find such a group of hard headed, difficult people as live in David City. I have heard more than one person say all the people in David City do is fight. David City is too big of a city to be with out local police. They are there own worst enemy. For sure they are not about to change they like to think they know it all.

I quit driving through David City in the early 90s because of the police there. They'd pull you over for 5 mph over the speed limit and I was followed many times just going through town.

Just build a police 'hut' just north and south of David City so they could have a standing road stop to check your papers.

I agree with recalling Trowbridge!!! It is too bad they weren't able to get it done the first time. He has that city government so messed up it is rediculous!!! He was so ballsy as to try to appoint his own wife to the City
Council when one of it's members resigned!!! He is just way to arrogant!!!! As for the Police Force, I wonder if the Sheriff's Dept. will have as much time to run radar on Hwy 15 as the City Boys did before???

Well, southsider, isn't running radar part of the job of a police officer? And, Brian, if you're not going even 1 mph over the speed limit, i.e. not breaking the law, you're not going to get pulled over. It really amazes me what some people find to complain about. Chief Sunday was an honorable man that ran the police department with honesty. Sheriff Hecker is best known for his infidelity and getting his employees' wives pregnant. Enough said...

I used to be a small town officer. I have since moved to a large agency because I could no longer put up with the small town politics dictated who we could take action against and who we had to let go just because they had a certain last name.

What I love seeing is when the State Patrol rolls into these small towns and begins cleaning house. They arrest people for DUIs and cite drivers for traffic violations. They also pull jalopy commercial and farm vehicles off the roads and cite the operators for not having the proper licenses or certifications to operate such vehicles.

The locals hate this because they can’t go running to the local town police chief, mayor, a city council member, or county sheriff and then see the citations magically disappear, as is all too common in rural communities. They can go complain to NSP Commanders about Troopers doing their jobs and they will be told to pound sand, just as it should be.

It sounds like NSP needs to roll into David City and clean that town up.

re: Former resident: Sure it's fine if the police want to pull over people for going 30mph in a 25mph zone. Sure it's fine if people get tickets for not using a cross-walk. That's fine, I know for anally retentive people, that's just enforcing the law.

...but I have the option of driving through David City, if I did, I'd possibly buy gas, food, etc before continuing to Lincoln or Columbus. My point is, I haven't got 1 ticket or or otherwise spent one dime in David City in the last 15 years because of the heavy handed police. David City just got the reputation with me and all my friends of, "Don't bother driving through David City, the police there are terrible"

Brian, I'm glad you and your friends dont drive through david city. I'm 30 and moved back to this town because of the great community it is! I have no help or support from family, I made the choice for my family on my own and never regretted it! That being said, I'd pull anyone over for breaking the law. I dont care if it's 3MPH or 30MPH over the limit. Your the type that complains about getting a ticket for not buckling up, I say raise that penalty because I've seen people die first hand becasue they didnt buckle up and were speeding! So Brian dont give us you winey pathetic speech about how DC has lost your pennies because your to boneheaded to slow down.

As for this article, Gretna doenst have a local police department. A comment was made that DC is to large to not have a police department. Go look how big Gretna is! I'm in favor of a smarter/brighter David City and if the city can save $$ by contracting through the county, then by all means do it. Yes we have a butthead for a Mayor right now, but hes gone in Nov. Things will turn around and I can't wait to see how happy people will be because all the nit-picking and fighting will gone. Brian, you discust me for complaing about getting a ticket when you broke the law. You must have been born in a barn!

I think it is really a shame one man can cause so much trouble and heart ache in one town. And soon he will be out of office and who then would want the job and try to pick up the pieces. David City is a really nice place to live and raise a family. Good health care facilities, good schools and churches, manufacturing, stores downtown if we would all shop in them. It is a very friendly place to be. I hope it can get past this.

Looking at the cost comparison I would think this seems to be a big win for residents just on the money they would save. Most every county sheriff I have ever met has been a good guy. They need to be fair to everyone to keep their job with the voters. In contrast the local police chief needs to just suk up to a few scoundals that have money and influence to keep their job. I have met Hecker a few times and I am sure David City residents will be very safe with him in control.

Looks like a lot of cost savings and greater efficiency with the county option. Having had a place in Bellwood for a few years, my experiences with Deputy Tooley and others in the dept. were nothing but positive. They were good people interested in protecting and serving their constituents, not "cleaning house."

I also like the Sherrif's accountability directly to the voters. Friends of mine from other countries still cannot believe that people here actually have the power to vote in and out their own sherrif.

This is a good thing!

According to the Lincoln Journal Star, the votes elected to keep their police department, 674 to 350 votes.

I applaud you for having the strength and fortitude for being 30 years old and having the ability to move back to David City without ANY help from your parents! Wow, I truly commend you on such a noble achievement. Try not to break your arm patting yourself on the back. But myself, I was recruited to work for a company very near David City and refused because I like civilization.

By the way, 'discust' is actually spelled 'disgust'.

If you're the type of cop that pulls people over for 3mph over the speed limit, do me a favor, stay in David City. We'll never meet then.
