City man placed on probation for breaking dog-limit law

COLUMBUS -- A 49-year-old Columbus man will be paying for months to come for keeping too many of his best friends around the house.

Platte County Court Judge Frank Skorupa sentenced Herman Hamilton Wednesday to 18 months probation and ordered the defendant to pay more than $1,200 in restitution for violating the city’s dog-limit ordinance.

“During your term of probation,” Skorupa told the defendant, “you are not to be in possession or control of any animals.” The judge ordered Hamilton to begin paying at least $75 a month in restitution beginning next month.

The restitution to the city is for the costs of sheltering the dogs that animal control officers removed from Hamilton’s home in September.

Hamilton was cited Sept. 11, after Columbus Animal Control received a health complaint, for keeping seven dogs at his home in the 900 block of Becton Street.

Just SEVEN Dogs??
This is a problem??

I was figuring the guy had 25, or 30 dogs the way the article started out!

Are they Chihuahua's, or Great Danes?

Wow! 7 dogs...? I thought I'd be reading about 15 or 20 and about what a huge effort animal control had to make to seize them all. Big freakin deal!!!

Why was animal control involved? Was it due to "nosy" neighbors? Let the man be with his best friends! I, myself, have a neighbor that thinks she can run our whole neighborhood by being a snoopy, snooty, nosy neighbor. Half tempted to call animal control on her and all other nosy neighbors. Mind your own business why don't you. Let the man be with his animals!

Seriously this is ridiculous. You're only allowed to keep 3 dogs or 3 cats, but how many children do some of the people around here have? Animals are MUCH easier to take care of than children, so what's wrong with it? As long as he's not abusing them or neglecting them, WHY is there a problem with this?

Way to go Judge. Give someone probation and a bigger fine for having to many dogs, and only $450.00 for someone that has a accident and hurts people and there family.

So he must love dogs, why have they taken all of them away and forbid him to own any. There has to be some kind of problem with the care of the dogs. Did they have shots, were they fed and trained right. Were they mean. If the man could not provide proper vet care, food, cleanup and training then maybe he should not have them Why can he no have even one. There must be more to the story of why this happened.

Attention all you legal eagles or beagles out there. Is this city ordinance constitutional in the context of the State of Nebraska Constitution. I.e. is it a uniform city ordinance across the state that criminalizes the number of dogs owned? What conduct is criminal? How specific is the ordinance? If it is health-safety directed, likely could be challenged as being to vague to allow citizens to know what the criminal behavior is and is not.

Columbus again shows it is in the stone ages & not the city of "Power & Progress". Omaha allows 5 dogs. I do not think that 3 dogs is a reasonable limit in this day and age when man's best friend has become even a more important member of the family.

Animal lovers of the community: Please contact the City Administrator, Mayor, and your city councilman to encourage them to pass an ordinance to increase the dog limit to 5 dogs (only if all dogs are spayed and neutered) and from there allow residents to apply for a special permit to even have more animals than that (again if spayed and neutered & with proper vaccinations). I am friends with several responsible dog owners that have numerous dogs and they are all fully vetted, well mannered, do not bark & are in the house most of the time.

I agree with snowflake in that what would government should be limiting is the number of children people can have. There seems to be en epedemic of people having children they cannot afford who are more destructive than dogs.

The article does state there was a call for a health complaint at this address. I would like more information on this story. Was he given a written warning & a chance to find homes for these dogs & possibly clean up his property...or were they just seized? I wish Columbus Animal Control would work with helping people rather than punishing them.

If Herman had 7 dogs and the limit is to only have 3 dogs then 7 dogs minus 3 dogs makes 4 dogs too many.... How come Herman was left with no dogs instead of the 3 he is permitted to have. Sounds like he is just being picked on by someone who wants to push weight around....

I say we donate money to this guy for helping out these dogs. This would be a great slap in the face to the Columbus judicial system and their lack of common sense. Wow what a crime!

Wow Columbus, you did it again! Never a suprise to see you blow stuff way out of proportion. I currently own 5 small dogs (which will stay small) which are potty trained, obey all commands and never bark. I live in Butler county but thought of moving to Columbus about 2 years ago...untill I heard about their "DOG LIMIT LAWS." This is just rediculus and un-heard of. Needless to say, I'm still residing in Butler county! At least the guy didnt have like 15 pit bulls.

if you read the whole article, the place was full of feces and fleas & children were living in the home. i think this story,taken out of context does show a ridiculous crime and punishment not worthy of a spot in the newspaper. With all the facts however the punishment is definately justified. I wouldn't allow my children to live like that. Would you? What if these were your neighbors?

I really am shocked at this when I compare what he got to what rapists and child molesters get in your fair town.

He must have been on the wrong side of someone in the police department or the court/judge.
